The building permit — mandatory before breaking ground — is a process that looks complex to many but can be completed without problems when the right steps are followed.
A building permit is the official authorisation by the municipality confirming that the proposed building complies with the zoning plan, technical regulations and the approved project. Under Zoning Law No. 3194, construction without a permit is illegal; stop-work orders, fines and demolition orders can follow.
The core documents for a permit application are: current title deed, zoning status certificate (obtained from the municipality), approved architectural project (prepared by a licensed architect), approved structural (reinforced concrete) project, geotechnical investigation report, electrical and mechanical service projects, energy performance declaration and application form. Many large municipalities now accept online submissions via the e-government portal.
1. Zoning status query: Confirm the plot's zoning zone, TAKS/KAKS values and construction conditions at the municipal planning office. 2. Architectural and structural projects: Prepared by a licensed architect and structural engineer in compliance with zoning conditions. 3. Geotechnical investigation: Conducted by an accredited laboratory — borehole drilling, sampling and soil analysis. 4. File submission: All documents submitted to the municipality; digital upload via e-government where available. 5. Municipal review: Review period varies from 30–90 days. 6. Fee payment and permit collection.
Once the permit is issued, construction may commence; however, the process does not end there. When construction is complete, a separate application for an occupancy certificate must be filed. The certificate is issued following a positive building inspection report and a municipal site inspection. A building without an occupancy certificate cannot legally be occupied.
